Please read these Terms carefully before using TachoCard. By creating an account or using our service, you agree to be bound by these Terms. If you do not agree, do not use TachoCard.
TachoCard is a cloud-based tachograph data management and compliance platform owned by Info Data SRL in the EU ("we", "us", "our"). Contact: legal@tacho-card.com.
You must be at least 18 years old and have the legal capacity to enter into contracts to use TachoCard. By registering, you confirm that:
You are responsible for all activity that occurs under your account. One person or legal entity may maintain only one free account. Company accounts may add multiple team members with role-based permissions (Owner, Admin, Manager, Viewer) as described in the application.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the free plan (e.g., creating multiple free accounts to circumvent limits).
TachoCard offers the following plan types (pricing is displayed on our Pricing page and may change with notice):
An "active driver" for billing purposes is any driver for whom at least one tachograph file was processed during the billing period.
Company accounts receive a 15-day free trial. No credit card is required to start the trial. At the end of the trial, the account will revert to a limited state unless a payment method is added and the subscription is activated.
Payments are processed by Stripe, Inc. By providing a payment method, you authorise TachoCard and Stripe to charge the applicable subscription fee on the billing cycle you have selected. Subscriptions renew automatically until cancelled.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the period ends. We do not issue pro-rated refunds for the unused portion of a billing period, except where required by applicable consumer protection law.
We may change subscription prices with at least 30 days' notice by email. Continued use of the Service after the price change constitutes acceptance of the new pricing.
A Company Account may invite drivers to affiliate with the company. An affiliated driver's tachograph data is accessible to that company's authorised users within the application. By accepting an affiliation invitation, the driver grants the company permission to view their compliance data within TachoCard. Either party may terminate the affiliation at any time from within the application.
You agree not to use TachoCard to:
TachoCard is a tool to assist with compliance; it does not replace the legal obligation of drivers and operators to comply with EU transport regulations.
You retain ownership of all tachograph data and files you upload to TachoCard. By uploading data, you grant TachoCard a limited, non-exclusive licence to store and process that data for the sole purpose of providing the Service to you.
We will not access your tachograph data for any purpose other than service delivery, security, and debugging, and only then with the minimum necessary access.
Upon account deletion, your data will be permanently erased within 30 days, except where retention is required by law (e.g., billing records).
TachoCard is provided "as is" and "as available". While we make every effort to ensure accuracy, the Service is a decision-support tool and does not constitute legal advice. We do not guarantee that:
You are responsible for verifying compliance with applicable EU and national transport regulations.
To the maximum extent permitted by applicable law, Info Data SRL shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to fines, penalties, or losses resulting from reliance on TachoCard reports or alerts.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to TachoCard in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under Romanian or EU law.
TachoCard offers physical hardware products (e.g. tachograph card readers) through its online store. Purchases of physical products are subject to the following consumer rights under EU Directive 2011/83/EU (Consumer Rights Directive) and EU Directive 2019/771/EU (Sale of Goods Directive):
If you are a consumer (natural person purchasing outside a commercial or professional capacity), you have the right to withdraw from a distance contract for physical goods within 14 calendar days from the day you or a nominated third party takes physical possession of the goods, without giving any reason.
To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement (e.g. by email to support@tacho-card.com) before the 14-day period expires. You must return the goods within 14 days of notifying us.
Return shipping costs are borne by you unless the goods are defective or not as described. We will reimburse all payments received using the same means of payment you used, without undue delay and no later than 14 days after we receive the returned goods.
The right of withdrawal does not apply to: goods made to the consumer's specification; sealed goods not suitable for return for health or hygiene reasons once unsealed; digital content not supplied on a tangible medium once download has begun with the consumer's prior consent.
All physical goods are covered by a 2-year legal guarantee of conformity under EU Directive 2019/771/EU. If goods are defective, do not conform to the contract, or malfunction within 2 years of delivery, you are entitled to repair, replacement, a price reduction, or a full refund, at no cost to you.
We aim to dispatch orders within 2–3 business days. Estimated delivery times are shown at checkout and depend on the destination country. Delivery risk passes to you (or a nominated third party) upon physical receipt of the goods.
The withdrawal right and legal guarantee provisions in §12.1 and §12.2 apply only to consumers. Business customers purchasing for commercial purposes accept goods under standard commercial terms and may not invoke the 14-day withdrawal right.
These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the courts of Romania for any dispute arising from these Terms.
If you are a consumer resident in another EU member state, you retain the benefit of any mandatory consumer protection provisions of your country of residence and may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms from time to time. For material changes, we will notify registered users by email at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if you breach these Terms materially. Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, 11, and 13 survive termination.
